1. Definitions

1.1 In these general terms and conditions, hereinafter referred to as: “General Terms and Conditions,” the following terms shall have the following meanings:

1.2 “Participant”: the natural person who, pursuant to the Agreement between AJAX CAMPS & CLINICS and the Client, uses the services of AJAX CAMPS & CLINICS in the capacity of participant.

1.3 “Registration form”: form that is part of the website “www.ajaxcampsenclinics.nl” of AJAX CAMPS & CLINICS.

1.4 “Client”: the natural person or legal entity that enters into the Agreement with AJAX CAMPS & CLINICS.

1.5 “Agreement”: an agreement between AJAX CAMPS & CLINICS and the Client regarding one or more services to be provided by AJAX CAMPS & CLINICS for the benefit of the Client and the Participant.

1.6 “Participation costs”: the total sum of the services to be provided by AJAX CAMPS & CLINICS – in relation to an Agreement concluded with the Client – including VAT.

1.7 “Ajax Camps & Clinics”: Players United Events B.V., established in Aalsmeer.

2. Applicability

2.1 These General Terms and Conditions apply to all offers made by AJAX CAMPS & CLINICS, order confirmations, and any resulting or related agreements or further agreements concerning the “Ajax Camps & Clinics.”

2.2 AJAX CAMPS & CLINICS expressly rejects the applicability of any general (or specific) terms and conditions or provisions of the Client.

2.3 Deviations from or additions to the Agreement or the General Terms and Conditions in any form whatsoever are only valid if AJAX CAMPS & CLINICS has agreed to them in writing.

2.4 In the event of a conflict between the provisions of the General Terms and Conditions and/or provisions of the Agreement, the latter shall prevail.

2.5 If any provision of these General Terms and Conditions is not applicable or is contrary to Public Order or the Law, only the relevant provision will be deemed not to have been written and the remaining General Terms and Conditions will remain in full force.

3. Formation of the Agreement

3.1 All offers made by AJAX CAMPS & CLINICS are without obligation and subject to availability, unless expressly agreed otherwise.

3.2 The Agreement is concluded after the Client has completed the registration form on the website, ticked the box to accept the general terms and conditions, and submitted the form.

3.3 Within 14 days of receiving confirmation of receipt of the registration via the submission of the registration form, this registration may be canceled free of charge without giving any reason, provided this is done in writing. Cancellation must be addressed directly to AJAX CAMPS & CLINICS.

4. Payment

4.1 iDEAL payment: Ajax Camps & Clinics offers the option of paying via iDEAL (only possible for payments within the Netherlands). With this payment method, you can complete the payment directly during the registration process with your own bank. You pay in your trusted internet payment environment, based on specific security methods of your own bank. If you use online banking, you can use iDEAL immediately, without having to register for it.

4.2 Credit Card payment: Ajax Camps & Clinics offers the option of paying by Credit Card (Visa and MasterCard). Additional costs will be charged for Credit Card payments. The additional costs are 5% of the total amount, with a minimum of €5 and a maximum of €15.

4.3 If and insofar as timely payment is not made, the Client will be in default by operation of law, without any notice of default being required.

4.4 In the event of late payment, AJAX CAMPS & CLINICS reserves the right to cancel the Agreement and the Client will be liable for the cancellation costs, with due observance of the provisions of Article 9, paragraph 4 of the General Terms and Conditions.

5. Instructions and rules of conduct

5.1 Participants are obliged to comply with all reasonable instructions from AJAX CAMPS & CLINICS to promote the proper execution of the Agreement. Participants must also respect the rules of conduct that AJAX CAMPS & CLINICS wishes to see observed during their stay at accommodations under the Agreement.

5.2 Participants who cause nuisance or disturbance to such an extent that it significantly impedes the proper performance of the Agreement by AJAX CAMPS & CLINICS may be excluded from (continuing) participation by AJAX CAMPS & CLINICS. All resulting costs and damage will be borne by the Participant.

6. Liability of AJAX CAMPS & CLINICS

6.1 All luggage and other personal belongings remain at the Participant’s risk at all times. AJAX CAMPS & CLINICS accepts no liability for damage to (valuable) items, luggage, and other personal belongings of the Participant, whether or not these have been entrusted to the staff of AJAX CAMPS & CLINICS, except in the event of damage caused by intent or gross negligence on the part of AJAX CAMPS & CLINICS. – no liability for damage to (valuable) items, luggage, and other personal belongings of the Participant, whether or not entrusted to the staff of AJAX CAMPS & CLINICS, as a result of theft, loss, or damage.

6.2 AJAX CAMPS & CLINICS also accepts no liability for any form of discomfort, medical problems, or injury arising as a result of drinks, lunches, or other forms of food offered if neither the Client nor the Participant has expressly indicated that they have any form of allergies/intolerances.

6.3 AJAX CAMPS & CLINICS accepts no liability for damage for which compensation can be claimed under travel and accident insurance or under third-party (liability) insurance policies involved by AJAX CAMPS & CLINICS in the performance of the Agreement.

6.4 Without prejudice to the provisions of the previous paragraph of this article, any liability on the part of AJAX CAMPS & CLINICS is limited to the amount that can be claimed in the relevant case under its liability insurance(s).

7. Liability of the Client

7.1 The Client is jointly and severally liable for all damage incurred by AJAX CAMPS & CLINICS and/or any third party as a direct or indirect result of an attributable shortcoming—including non-compliance with the rules of conduct below—on the part of the Participant.

7.2 The Client shall indemnify AJAX CAMPS & CLINICS against claims from third parties for compensation for damage arising from or related to the Participant’s use of facilities and/or services pursuant to the Agreement.

8. Force majeure/Changes/Cancellation AJAX CAMPS & CLINICS

8.1 If AJAX CAMPS & CLINICS is wholly or partially prevented by force majeure from fulfilling one or more of its obligations under the Agreement, AJAX CAMPS & CLINICS shall be entitled to offer an alternative that it deems equivalent or to dissolve the Agreement in whole or in part without judicial intervention, without being liable for any compensation to the Client.

8.2 Force majeure includes, but is not limited to, all external causes, foreseen or unforeseen, over which AJAX CAMPS & CLINICS has no influence, but which prevent AJAX CAMPS & CLINICS from fulfilling its obligations. This includes, among other things, diseases, pandemics and/or epidemics, natural disasters, extreme weather conditions in the Netherlands and/or weather conditions that make it impossible to use the location, strikes, and force majeure on the part of third parties on whom AJAX CAMPS & CLINICS is dependent in any way. Regardless of the foregoing, force majeure as referred to in paragraph 1 of this article also explicitly includes insufficient registrations for participation in an event. This is the case if the number of registrations is less than 70% of the maximum number of participants per event.

9. Cancellation by the Client

9.1 The provisions below regarding cancellation shall not apply if the cancellation, and thus the termination of the Agreement, takes place within the statutory period of 14 days after the conclusion of the Agreement.

9.2 Cancellation must be made in writing, whereby the date of receipt of the cancellation email by AJAX CAMPS & CLINICS will serve as the reference date for the provisions of paragraph 4 of this article.

9.3 In the event of cancellation due to demonstrable illness, injury, or serious calamities, €12.50 in administration and cancellation costs will be deducted from the registration fee already paid. The remainder of the registration fee will be refunded to the specified bank account. In the event of illness or injury, a doctor’s statement must be submitted to AJAX CAMPS & CLINICS by email.

9.4 If the Agreement for a Clinic is canceled for reasons other than those mentioned in paragraph 2 of this article, the following amount will be charged per Participant:
– €12.50 administration and cancellation costs, if the cancellation is received up to 6 weeks before the event.
– 25% of the registration fee, if the cancellation is received between 6 and 2 weeks before the event.
– 50% of the registration fee, if the cancellation is received between 14 and 7 days before the event.
– 75% of the registration fee, if the cancellation is received between 7 and 2 days before the event.
– 100% of the registration fee if the cancellation is received in writing or by telephone on the day before the event or on the day of the event.

9.5 In the event of cancellation of the Agreement for a Camp on grounds other than those mentioned in paragraph 2 of this article, the following amount will be charged per Participant:

– €12.50 administration and cancellation costs, if the cancellation is received up to 6 weeks before the event.
– 25% of the registration fee, if the cancellation is received within 6–2 weeks before the event.
– 50% of the registration fee, if the cancellation is received within 14–7 days before the event.
– 75% of the registration fee if the cancellation is received within 7–2 days before the event.
– 100% of the registration fee if the cancellation is received in writing or by telephone on the day before the event or on the day of the event.

9.6 If the registration fee has been paid by credit card, additional costs will be charged for this pursuant to Article 4, paragraph 2. In the event of cancellation of such a registration, these additional costs will not be refunded.

9.7 If the Client has registered a participant multiple times for the same Camp or Clinic, the registration fee for the excess Camp or Clinic will be refunded upon cancellation, less €12.50 in administration and cancellation costs.

10. Lost and found

10.1 Lost property will be kept by AJAX CAMPS & CLINICS for seven days after the end of an event. After this period, AJAX CAMPS & CLINICS is entitled to donate these items to a charity of its choice.

11. Applicable law and disputes

11.1 The Agreement and all agreements arising from it are governed exclusively by Dutch law.

11.2 All disputes arising between the parties in connection with the Agreement or agreements arising from it will be settled by the competent court in Amsterdam.

12. Other provisions

12.1 Visual material of the AJAX CAMPS & CLINICS activities and its participants, recorded on site and at the various AJAX CAMPS & CLINICS locations, may be used by AJAX CAMPS & CLINICS as well as by its partners (location owners, clubs, event locations) in its communication tools to promote AJAX CAMPS & CLINICS. The visual material obtained will be stored by AJAX CAMPS & CLINICS for an indefinite period of time. 12.2 Ajax Camps & Clinics reserves the right to make changes to these General Terms and Conditions. It is therefore advisable to check these terms and conditions regularly so that you remain informed of any changes. The most current version can always be consulted on the website.
